Terms and Conditions

NOTICE OF CERTAIN TERMS AND CONDITIONS

THIS AGREEMENT CONTAINS PROVISIONS, WHICH ARE RECORDED IN A SIMILAR FONT TO THIS CLAUSE, AND WHICH PROVISIONS MAY HAVE THE EFFECT OF (I) LIMITING VODACOM’S LIABILITY OR RISK OR THAT OF A THIRD PARTY AND/OR (II) PLACING RISK OR LIABILITY ON THE CUSTOMER AND/OR (III) OBLIGING THE CUSTOMER TO IDENMNIFY VODACOM OR A THIRD PARTY AND/OR (IV) CONSTITUTING A POSITIVE ACKNOWLEDGEMENT BY THE CUSTOMER OF ANY FACT.

BY MAKING USE OF THE SERVICE(S) AND / OR PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

Vodacom Fibre Broadband Zero-NRC Bitstream Promotion Summary

These terms and conditions apply to the Vodacom Fibre Broadband Service on the selected Bitstream Fibre Networks (hereinafter collectively referred to as ‘the Service’). Vodacom will run a promotion from the 22nd November 2019 to the 31st March 2020 during which period, price plans will be offered for which the once off activation fees (NRC – Non Recurring Charges) are discounted.

Vodacom Fibre Broadband Terms and Conditions

1.     The standard Terms and Conditions for the Vodacom Fibre Broadband Price Plans apply and are available at the following link:

2.     Specific emphasis is placed on Installation (also termed Standard Installation) vs Non-Standard Installation and the subsequent costs. Installation in this document refers to the standard installation as referenced in the link above. Non-standard installation costs are borne by the subscriber for their own account as per the standard Terms and Conditions and are subsequently not included in any discounted benefits. Non-standard installation costs as described in the standard Terms and Conditions are not part of the promotion as described herein. For clarity, customers who reside in an area serviced by Waterfall Access Networks or Izinga Phase 2E serviced by SADV, will fall under the Non-standard installation and be liable for an installation charge. Refer to the standard Terms and Conditions for more information.

Vodacom Fibre Broadband Zero-NRC Bitstream Promotion Terms and Conditions

In addition to the standard Terms and Conditions above, the following Terms and Conditions apply to the Vodacom Fibre Broadband Zero-NRC Bitstream Promotion:

3.     Promotion validity:

 ·         promotion period from the 22nd November 2019 to the 31st March 2020

·         for the following Bitstream networks

·         Century City

·         DFA

·         Frogfoot

·         Link Africa

·         Metrofibre

·         MTN

·         Octotel

·         Openserve

·         SADV

·         TT Connect

·         WAN

 

·          for any eligible Vodacom Fibre Broadband standard price plan offered on the afore mentioned bitstream networks

·          Month to month and 12 month contracts (24 months contracts already have a zero NRC except on Link Africa)

·         Only applicable to FTTH customers on new orders

·         The promotional benefit is not applicable to Fibre Integrated Deals and Vodacom One Deals.

 

4.     The promotional offer is subject to a successful credit vetting and conclusion of a new customer contract

5.     A customer who is approved for a promotional offer will be allocated the promotional benefit regardless of whether the customer is installed during or after the promotional period. For clarity, the customer orders the service during the promotional period and is allocated the associated discount. However the service is only activated after the promotional period. The customer will still receive the promotional discounts.

6.     Discounted non-recurring charges for 12 month and month-to-month contracts include:

·         Vodacom Fibre Broadband 12 month contract activation charge of R505 (incl VAT), R2020 (incl VAT) for Link Africa: 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 12 months)

·         Vodacom Fibre Broadband month-to-month contract activation charge of R1010 (incl VAT), R2525 (incl VAT) for Link Africa: 100% discount  (subject to a pro-rata cancellation clawback if the Service is cancelled before 12 months)

·         Delivery Cost of the Vodacom Router: 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 12 months)

·         Vodacom Router cost: Which does not include additional costs of devices such as LTE dongles and Sim cards, which will be clawed back in addition to the Router cost): 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 12 months)

·         Network Activation and Installation Cost (Refers to the Standard Installation and is Specific to each network): 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 12 months)

 

7.     Discounted non-recurring charges for 24 month contracts on Link Africa include:

These charges are subject to change and specific costs can be requested as part of the cancellation request.

·         Vodacom Fibre Broadband 24 month contract activation charge of R1815 (incl VAT): 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 24 months)

·         Delivery Cost of the Vodacom Router: 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 24 months)

·         Vodacom Router cost: Which does not include additional costs of devices such as LTE dongles and Sim cards, which will be clawed back in addition to the Router cost): 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 24 months)

·         Network Activation and Installation Cost (Refers to the Standard Installation and is Specific to each network): 100% discount (subject to a pro-rata cancellation clawback if the Service is cancelled before 24 months)

8.     The 100% discounted charges are only applicable based on the condition that the customer / subscriber will utilise the Service for a period of at least 12 months on the month to month and 12 month price plansand for at least 24 months on the Link Africa 24 month price plans. 

9.     Should the customer / subscriber elect to not take up a service with Vodacom but has completed the network installation (Standard Installation), the cost of this network installation will be levied onto the customer which will be paid in full to Vodacom.

10.   Should the customer already have an existing network installation for which they have paid the network installation cost, and chose Vodacom as the ISP, the customer will not receive any additional benefit or re-imbursement for the installed network service.

11.   The promotional benefit for any discounted network installation charge is valid for one network installation only. Should the customer relocate to a new premises where a network installation is required, this additional network installation may have an associated cost, for which the customer will be liable.

12.   Should the customer / subscriber cancel the Service within 12 months (or 24 months for the Link Africa 24 month contract), the recovery costs is calculated as follows for each of the applicable discounts above, the total recovery cost will be the balance of the installation charge plus the balance of the applicable activation charge and any additional charges incurred by Vodacom in the process.

For 12 month and month to month contracts:

Recovery Cost (Installation) = [12 months – total months on the existing price plan = balance] X Discounted Charge / 12

Recovery Cost (Contract Activation) = [12 months – total months on the existing price plan = balance] X Discounted Charge / 12

Recovery Cost (Router Delivery) = [12 months – total months on the existing price plan = balance] X Discounted Charge / 12

Recovery Cost (Router Hardware) = [12 months – total months on the existing price plan = balance] X Discounted Charge / 12

Recovery Cost (Network Activation) = [12 months – total months on the existing price plan = balance] X Discounted Charge / 12

Total Recovery Cost (Promotion) = Recovery Cost (Installation) + Recovery Cost (Contract Activation) + Recovery Cost (Router Delivery) + Recovery Cost (Router Hardware) + Recovery Cost (Network Activation)

For Link Africa 24 month contracts:

Recovery Cost (Installation) = [24 months – total months on the existing price plan = balance] X Discounted Charge / 24

Recovery Cost (Contract Activation) = [24 months – total months on the existing price plan = balance] X Discounted Charge / 24

Recovery Cost (Router Delivery) = [24 months – total months on the existing price plan = balance] X Discounted Charge / 24

Recovery Cost (Router Hardware) = [24 months – total months on the existing price plan = balance] X Discounted Charge / 24

Recovery Cost (Network Activation) = [24 months – total months on the existing price plan = balance] X Discounted Charge / 24

Total Recovery Cost (Promotion) = Recovery Cost (Installation) + Recovery Cost (Contract Activation) + Recovery Cost (Router Delivery) + Recovery Cost (Router Hardware) + Recovery Cost (Network Activation)

13.   Cancellation of the service will also result in the standard terms and conditions being triggered where the   subscriber will be liable for a balance of contract and applicable hardware clawback.
