Vodacom Broadband ADSL Service 

By using or subscribing to the Vodacom Broadband ADSL Service ("the Service") the Subscriber agrees that the Subscriber has read, understands and is bound by the following terms and conditions and the terms and conditions available on the Vodacom Website referring generally to all services offered by VSP (collectively "the Agreement"). 

The Subscriber's use of the Service indicates the Subscriber's acceptance without modification by the Subscriber of the Agreement. 

  1. INTERPRETATION

    In these Service Terms: 

    1. "Activation Date" shall mean the date of the activation of the Service on the Network;

    2. "ADSL line" means an Asymmetric Digital Subscriber Line;

    3. "Application form" shall mean the application completed by the Subscriber when subscribing to the Service;

    4. "Agreement" means the Application Form together with the Terms and conditions applicable to the Service as amended from time to time;

    5. "Equipment" means all equipment installed at the Subscriber's premises to enable the Subscriber to gain access to the Service including but not limited to the router or ADSL Modem that connects the Subscriber's computer to the ADSL Line at the Subscriber's premises which is either owned by the Subscriber ("Subscriber Equipment") or supplied and owned by VSP ("VSP Equipment") including any Software embedded therein or used in conjunction with the Service;

    6. "Fixed Term" means the fixed period of either 12 (twelve) or 24 (twenty four) months as indicated on the Application Form;

    7. "Fixed Telephone Line/ Service" means a residential (POTS) copper telephone fixed telephone line and/or service for making and receiving telephone calls ( e.g. analog Telkom line);

    8. "Fixed Line Operator" means the Fixed Telephone Service provider e.g. Telkom;

    9. "GB" means Gigabytes;

    10. "Kbps" means kilobits per second;

    11. "MB" means megabyte;

    12. "Modem or Router" means the device which is used to connect the Subscriber computer to the Fixed Line Telephone Service, in order to enable the Service;

    13. "Network" shall mean the public mobile telecommunications system operated and made available by Vodacom;

    14. "Regulatory Authority" shall mean the Independent Communication Authority South Africa (ICASA) and its successors in title;

    15. "Software" means any computer programme, software or other materials installed or provided by or on behalf of VSP and/or Vodacom for the purpose of using any Equipment or the Service, including any computer programme, software or other materials embedded in or used in conjunction with Equipment and/or any electronic communications system or equipment operated or maintained by VSP and/or Vodacom;

    16. "Service" means the provisioning of an ADSL service by means of the Asynchronous Digital Subscriber Line technology that enables the Subscriber to send and receive data and email and to access the Internet using a high-speed connection as well as such other additional services or equipment as VSP may, at its sole option, make available to the Subscriber from time to time, pursuant to these terms and conditions;

    17. "Service Charge" means the amount payable by the Subscriber for the Service as varied from time to time and specified in the Tariff, it being recorded that the Service Charge applicable as at the time of signature of the Agreement is recorded in the Application Form;

    18. "Subscriber" shall mean the person or entity entering into this Agreement with VSP and who is more fully described in the Application Form.

    19. "Shaped Internet access" means that traffic is prioritised and channelled in a specific order, i.e. priority is given to email, web browsing, Internet banking and "normal" downloads via a web browser or File Transfer Protocol (FTP) program. This implies that any other online activity not mentioned here will receive low priority when the network is busy. This option is most suited for users who do not want to carry out specialised online activities.

    20. "Tariff" shall mean the tariff of charges and fees payable to VSP in respect of the Services, as published by Vodacom from time to time;

    21. "Telkom" means Telkom SA Ltd;

    22. "Unshaped Internet access" means that the traffic is not prioritised and channelled in a specific order. The first service requested by the Subscriber is delivered first;

    23. "Vodacom" shall mean Vodacom (Pty) Ltd;

    24. "VSP" shall mean Vodacom Service Provider Company (Pty) Ltd with whom the Subscriber has entered into this Agreement for the provision of the Services;

    25. "Vodacom Website" means www.vodacom.co.za

    26. Any words denoting any one gender shall include the others, the singular shall include the plural and natural persons shall include other legal entities.

    27. All other words, expressions and phrases not specifically defined herein shall have bear the meanings assigned to them under any General Terms and Conditions available in the Vodacom Website or where not defined therein, their generally understood meaning in the ICT industry. 

  2. PROVISION OF THE SERVICE 

    1. The Subscriber can select from various Shaped ADSL products. For more information on the various products refer to the Vodacom Website. A Subscriber may purchase Internet access only. The ADSL line rental and the charges relating to the rental of the fixed telephone line will be charged separately by the ADSL provider and the fixed line operator.

    2. The Subscriber shall be required to have a Fixed Telephone Line and an ADSL line. 

    3. The Subscriber's area of residence must be located within an identified ADSL service area with the capability of connecting to various line speed rates i.e. 384 kbps, 512 kbps or 4 Mbps.

    4. VSP shall provide the Subscriber with a specific data package (1GB, 3GB, 5GB or 10GB) as selected by the Subscriber in the Application Form. Customer's throughput will be throttled to 16kbps upon depletion of their ADSL data bundles. The Subscriber shall be entitled to purchase Top Up (Ad-hoc) ADSL Bundles throughout the month and any unused Top Up (Ad-hoc) ADSL Bundles shall be carried over to the last calendar day of the following month. Any Top Up bundles purchased in the current month shall only expire on the last calendar day of the following month.

    5. VSP reserves the right to manage traffic on the Network in such a way as to ensure optimal performance of the Network including but not limited to limiting the number of emails that the Subscriber may send in any given period or to limit the total message volume (amount of data) sent per hour. VSP will manage bandwidth usage to the best of its ability during peak periods; however, it remains a best effort service. In addition VSP reserves the right to manage the Network in order to optimize its efficiency for the benefit of all subscribers. VSP may take any other action it deems appropriate in order to help ensure the integrity of the network experience for all subscribers. 

    6. Upon successful completion of the application process, successful credit vetting and VSP's approval, the Service will be activated ("Activation Date"). VSP will use reasonable endeavours to activate the service on or before the preferred activation date specified in the Application Form.

    7. The Subscriber will only use the Service for purposes that are lawful and for which it was designed and will not use the Service, directly or indirectly, in a way that

      1.  is harmful, obscene, discriminatory, defamatory or illegal; 

      2. constitutes hate speech, incitement to commit criminal acts, or invasion of privacy; infringes copyright or other intellectual property rights;

      3. spreads viruses or other computer or communications software, code, programs or files that impede or destroy the functionality of any computer or communications software or equipment;

      4. interferes with any third party's use of the Service; 

      5. transmits unsolicited bulk messages ("spam"); 

      6. unlawfully obtain information about or from third parties;

      7. otherwise breaches the terms or this Agreement; or 

      8. in VSP's sole discretion constitutes abuse of the Service or of VSP's systems. 

    8. Unless authorised by VSP in writing the Subscriber may not resell the Services, receive any charge or benefit for the use of the Services or provide any feature of the Services to any third party or in any other way exploit the Service for any commercial purposes. The Subscriber shall not use or permit the Service to be used, directly or indirectly, to carry or transmit (or facilitate the carriage or transmission) of any message, data or information which does not belong to or originate from the Subscriber or for the purpose of re-selling the Service without the prior written consent of VSP;

    9. The Subscriber may not restrict, inhibit or interfere with the ability of any person to access, use or enjoy the Internet or the Services, or create an unusually large burden on the Network or otherwise generating levels of traffic sufficient to impede others' ability to send or retrieve information, or use the Services in an abusive manner.

    10. VSP reserves the right to establish policies, rules and limitations, from time to time, concerning the use of the Service. The Subscriber must comply with any bandwidth, data storage and other limitations VSP may impose, in its sole discretion. Failure to comply with these rules will result in the Service being restricted, suspended or terminated, in our sole discretion. 

  3. DURATION 

    1. This Agreement will commence on the Activation Date and, subject to the terms of this agreement, shall continue for the Fixed Term ("the Initial Period") and thereafter will automatically renew and will continue on a month to month basis until terminated by either party on not less than 1 (one) calendar month's written notice.

    2. This Agreement may be terminated by either party on not less than 1 (one) calendar month's notice except that no notice may be given so as to require termination - 

      1. prior to the expiry of the Initial Period; and/or

      2. where an upgrade has been effected by the Subscriber, prior to the expiry of the Renewal Period. 

    3. In the case of a month to month arrangement, the Agreement will terminate upon receipt in writing from the Subscriber of 1 (one) calendar month's written notice, which notice will take effect on the first day of the month immediately following the end of the notice period. 

  4. SERVICE CHARGES 

    1. The first month's Service Charge may be due and payable by the Subscriber to VSP in full on the Activation Date and the balance of the Service Charge shall be due and payable to VSP by the Subscriber as specified on VSP's invoice therefor but in any event by no later than the last working day of each and every subsequent month until expiry of the Initial Period and/or Renewal Period, as the case may be. Billing will commence on the Activation Date.

    2. If the Subscriber subscribed to the Service in the middle of any calendar month, the first bill will include a pro-rata portion for the remaining period of the month in which the Subscriber signed up plus the Service Fee for the following month. 

  5. ACCESS TO SUBSCRIBER'S PREMISES 

    The Subscriber shall, whenever required by VSP, procure that VSP's personnel or contracted installer, be permitted access to the Subscriber's premises and to remain at such premises - 

    1.  to carry out any inspection, repair, testing or maintenance of any Equipment and other equipment relevant to the provision of the Service; and/or 

    2. to verify that the manner in which the Service is being utilised by the Subscriber is in compliance with the Agreement and applicable South African laws, rules and/or regulations; and/or

    3. to install, collect or remove any Equipment; and/or 

    4. for any other reasonable purpose whatsoever. 

  6. THE EQUIPMENT

    1. The Subscriber shall -

      1. obtain the prior written approval of VSP before connecting or permitting any third party to connect any equipment to any electronic communication system operated by Vodacom or any VSP Equipment; 

      2. use and maintain VSP Equipment in good working order (fair wear and tear excepted) in accordance with the specifications, guidelines and recommendations of VSP and the supplier or manufacturer of the VSP Equipment and shall disconnect and/or cease to use such VSP Equipment at the request of VSP;

      3. promptly comply with all notices, instructions or directions given by VSP in respect of the installation, use or operation of the Service, Software and/or VSP Equipment;

      4. provide at its own expense, as and when required by VSP, all facilities and resources necessary for the proper installation, operation and maintenance of the Service and all Equipment, including without limitation, power points, electricity, conduits and appropriate access; 

      5. ensure that all Subscriber equipment and all software installed by or for the Subscriber and used in conjunction with the Service is compatible with and will function with all other VSP equipment and Software; 

    2. The Subscriber shall not -

      1. use or permit the use of the Service or install, connect or link or use (or permit the installation, connection, linking or use) of any electronic communications equipment in contravention of any South African laws, rules and/or regulations

      2. carry out or permit to be carried out any additions, improvements, adjustments, modifications, alterations or replacements to any VSP Equipment or Software without the prior written consent of VSP; 

      3. use or permit the use of the Equipment in any manner or for any purpose whatsoever which generates or is likely to generate electronic communications traffic which causes or is likely to cause congestion in or disruption of the Service offered by VSP. 

  7. SUSPENSION & DISCONNECTION OF THE SERVICES: 

    1. VSP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services with or without notice. Without limiting the generality of the aforegoing VSP may from time to time and without notice to the Subscriber, suspend and/or disconnect the Service, in any one of the following circumstances:

      1. during any technical failure, modification or maintenance of the Network; or 

      2.  if the Subscriber fails to comply with any of the terms and conditions of this Agreement. The Subscriber shall repay to VSP on demand all costs which VSP incurs as a result of the Subscriber's failure to comply with the terms and conditions of this Agreement or any cancellation hereof; or

      3. if so directed by the Regulatory Authority.

    2. The Subscriber agrees that Vodacom shall not be liable to the Subscriber or to any third party for any modification, suspension or discontinuation of the Service.

    3. In the event that the Subscriber breaches any term of this Agreement, then without prejudice to VSP's other rights in terms of this Agreement or at law, VSP may forthwith and without notice to the Subscriber, terminate this Agreement or call for specific performance of the Subscriber's obligations and immediate payment of all sums owing by the Subscriber. The Subscriber shall pay to VSP all charges for access to the Network in respect of the unexpired portion of the Fixed Term. The payment of such charges shall be accelerated and same shall become immediately due and payable upon termination of this Agreement.

    4. If the Service is used in a way that VSP in its sole discretion deems unacceptable and /or violates any of VSP's rules or limitations, VSP may take any responsive actions it deems appropriate. Such actions may include without limitation, temporary or permanent filtering of Internet transmissions, and/or the immediate limitation, restriction, suspension or termination of all or any portion of the Services. 

  8. DISCLAIMER OF WARRANTIES 

    1. VSP does not make any express or implied representations, warranties or guarantees regarding the availability, accuracy, reliability, timeliness, quality or security of the Service. VSP cannot guarantee that the Service and the allocated capacity will always be available.

    2. The Subscriber acknowledges and agrees that the use of the Service is at the sole risk of the Subscriber. Neither VSP and/or Vodacom nor their agents, employees, suppliers, licensors and/or third party content providers ("VSP associates") warrant that the Service will be uninterrupted, error-free, secure, reliable or accurate, is fit for any purpose, is secure and reliable, or will conform to the Subscribe's delivery timeline requirements.

    3. Save as specifically set out herein, neither VSP and/or Vodacom nor the VSP associates make any warranty as to the results to be obtained from the use of the Service and the Service is made available to the Subscriber on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, accuracy or completeness of informational content, non-infringement or otherwise.

    4. VSP does not represent, warrant or guarantee or assume any responsibility for the quality of the Service or of the signals or the data transmitted as part of the Service and shall not be liable for any loss, cost, claim, damage or expense which may be caused by weak signals and/or data lost. 

    5. VSP may use or rely on third party service providers to provide the Service or certain portions thereof. VSP accordingly provides the Service subject to the limitations and terms imposed on VSP by such third party service providers. 

  9. LIMITATION OF LIABILITY

    1. VSP shall not be liable to the Subscriber or any third party for and the Subscriber indemnifies and holds Vodacom and VSP harmless against any expense, loss, claim, harm or damages brought against, suffered or sustained by either Vodacom or VSP, which arises directly or indirectly out from the Subscriber's subscription to or use of the Service and/or the VSP Equipment, a breach of the terms of this agreement either by VSP including (without limitation) any damages suffered by the Subscriber due to:- 

      1. any interruption of or error in the Service; or

      2. VSP's failure to fulfil its obligations as a result of a third party service provider's neglect, failure or refusal to make, or to continue to make, the services available to VSP including but not limited to act of default of any supplier, agent or sub-contractor. 

      3. VSP's failure to perform any obligations as a result of technical problems relating to the Network, termination of any license to operate or use the Network, any restrictions or prohibitions or other act or omission of the Regulatory Authority.

      4. VSP's failure to fulfil its obligations as a result of uncontrollable events. For purposes of this clause "uncontrollable events" means any circumstances beyond our reasonable control, including without limitation, an act of God, of public enemy, fire, explosion, earthquake, perils of the sea, flood, storm or other adverse weather conditions, war declared or undeclared, civil war, revolution, civil commotion or other civil strife, riot, blockade, embargo, sanctions, epidemics, act of any government or other authority, compliance with government orders, demands or regulations, or any act or omission on the part of a third party service providers. 

  10. GENERAL 

    1. VSP has the right to change or modify these terms and conditions at any time with the method of notice determined by VSP from time to time. The Subscriber agrees to be bound by such varied terms with effect from the date of notice or publication as the case may be.

    2. The Subscriber consent to the jurisdiction of the Magistrate's Court in terms of Section 45 of the Magistrate's Court Act (Act 32 of 1944), as amended. Vodacom is entitled to institute action in any Court of law. 

    3. The physical address stipulated in the application form shall be the Subscriber's domicilium citandi et executandi or as advised in writing from time to time. The Subscriber undertakes to notify VSP in writing within 2 (two) days of any change of address.

    4. In the interest of providing the Subscriber service excellence, and the protection of consumer rights, VSP conducts its business in accordance with a Code of Practice which incorporates a procedure for the Subscriber complaint resolution. Details of such Code of Practice and procedure may be accessed by the Vodacom Website or obtained from VSP's the Subscriber care department. 

    5. The Subscriber shall not be entitled to withhold any payment or set off or reduce any payment by reason of any claim which the Subscriber may have or aver to have against VSP.

    6. The Subscriber shall not cede, assign, transfer, encumber or delegate any of his/her rights or obligations in terms of this Agreement to any third party without the prior written consent of VSP.

    7. VSP reserves the right, in its sole discretion, to vary the terms and conditions of this Agreement. VSP may elect, in its sole discretion, to notify the Subscriber of such variation in writing or to publish such variation at its principal place of business, or on the Vodacom Website. 

    8. This Agreement constitutes the whole agreement between the parties and no representations or warranties other than those set out herein shall be binding on the parties, save for any amendment effected in terms of this Agreement. 

    9. In the event of any one or more of these terms and conditions being unenforceable, same will be deemed to be severable from the remainder of this Agreement which shall nevertheless be binding and enforceable.

Terms & Conditions

  1. In the case of Top Up Value you accept and acknowledge the following:

    1. The subscription fee will be due and payable to Vodacom (Pty) Ltd by you as indicated on the invoice received from Vodacom (Pty) Ltd each and every month. 

    2. Upon successful debit order submission, monthly airtime will only be allocated on confirmation of payment. This is done on the first day of each month for the duration of your Vodacom Contract Agreement whilst on a Top Up Value plan. Should your debit order be unsuccessful, we will notify you by way of SMS on the first day of each month and you will need to recharge until your next debit order date the following month.  

    3. In the event of three (3) unsuccessful debit orders, Vodacom may at their discretion convert you back to prepaid, cancel your contract and debit order. In the event this happens, you will be given a calendar months' notice before the conversion takes place. You will be converted back to the Vodacom4Less default prepaid tariff plan where you shall be entitled to free change to any other available prepaid tariff of your choosing. 

    4. You shall be entitled to recharge your prepaid account at any time by utilizing any of Vodacom's existing recharge mechanisms on such terms and conditions applicable to such recharges.   

  2. Each month for the duration of the agreement, you shall be entitled to carry over to the following month the;

    1. Unused portion of airtime value accrued pursuant to any additional recharges you may have performed; plus

    2. Any unused portion of the airtime value accrued pursuant to the payment of the subscription fee(s), provided that any such airtime may not exceed the equivalent of 5 (five) times the subscription fees, excluding the current month, or such other period as Vodacom (Pty)Ltd may specify from time to time. 

  3. Top Up Value customers may only purchase once off VAS and bearer service bundles (Voice, SMS, Data and MMS) with no charge to bill services permissible on this Plan.

    1. No migrations will be permissible to any other Price Plans within the first three (3) months of activation. In certain instances, some migrations may be subjected to a penalty fee and credit vetting.

  4. These Terms and Conditions do not replace any other Terms and Conditions, agreements or contracts that exist between you and Vodacom and should be read in conjunction with the Terms and Conditions associated with the Vodacom (Pty) Ltd contract agreement.

  1. 60 VODACOM to VODACOM minutes for the day
    1. 60 free Vodacom to Vodacom voice minutes (measured on a per minute basis) on calls made to Vodacom cell phone numbers valid until midnight on the day of issue 
    2. Subject to these terms, conditions and exclusions below all off-net calls will be billed to the customers prevailing price plan
    3. Once a customer has used up the 60 free Vodacom to Vodacom voice minutes they will begin paying again for voice calls made to Vodacom cellphone numbers at their current price plan rate. Thus, if a customer's 60 free Vodacom to Vodacom voice minutes run out while on a call, the customer will be billed at their applicable price plan:
    4. Discounted Vodacom 4Less rates and redeemed Talking Points discounted rates will not be applicable while the free minutes are active.
    5. All unused minutes will expire every day at midnight. 
    6. The call types that qualify for the free minutes are:       
      • Vodacom to Vodacom (on-net) voice calls.
      • Callback to Vodacom (on-net)
      • Call forwarding to Vodacom (on-net)
      • Through-Connect to Vodacom (on-net)
      • Conference calls to Vodacom (on-net)
    7. The following call types are excluded from the free minutes:
      • Voice and video calls to other SA Networks
      • Roaming calls
      • International calls
      • Video calls (to all networks)
      • Conference calls (to other SA networks)
      • Call Sponsor
      • VAS calls
      • Reverse Charge
      • SMS, MMS, Data, SVS
      • General Service calls
      • Directory Enquiry calls
      • Reconnect
      • Message forwarding
      • Fax Out dial
      • Call forwarding (to other SA networks )
  2. BONUS AIRTIME REWARDS: 
    1. Bonus airtime will be available in different denominations, as specified at the time of offer presentation
    2. Bonus airtime is valid for 1 or 7 days, as specified at the time of offer presentation, and will expire at 23:59 on the relevant day
    3. Bonus airtime can only be used for:
      1. Vodacom to Vodacom calls, billed at R2.00 per minute
      2. National /local SMS, billed at R0.50 each
      3. Data usage, billed at R2.00 / MB
    4. If Bonus airtime is depleted before the expiry, billing for usage will revert to other available voice, SMS or data bundles. If there are none, usage will be billed to airtime at the applicable out of bundle rate.
  3. 1GB DATA REWARDS:
    1. 1GB data rewards are valid for 1 or 3 days, as specified at the time of offer presentation, and will expire at 23:59 on the relevant day. 
    2. There will be no carry-over of data beyond the bundle expiry. 
    3. Customers will be charged for the volume of data sent and received, and not the time spent connected.
    4. Data transfer rates are not guaranteed and are dependent on network availability.
    5. Bundles and tariffs only apply to standard APNs.
    6. Data bundles do not apply to data roaming.
    7. If the data bundle is depleted before the expiry, data usage will revert to other available data bundles - if there are none, data will be consumed at the existing applicable out of bundle rate.
  4. 60MB or 100MB for 1day rewards
    1. The daily bundle is valid from the time of allocation until midnight of the same day
    2. The daily bundle cannot be used for roaming
    3. Migration from Prepaid or Top Up to a Standard Contract will result in a forfeiture of the allocated daily bundle.
    4. No Talking Points will be allocated upon receipt of the daily bundle reward
    5. Vodacom will use its best efforts to secure the allocation of the daily bundle reward, and will take all reasonable steps to correct any error, omission or mistake in daily bundle reward.
  5. Prepaid free 30 day once-off data bundles
    1. Free 30 day once-off data bundles may be allocated to Prepaid customers only. 
    2. Free 30 day once-off data bundles are valid up to midnight on the 30th day from and including the day of allocation.
    3. Free 30 day once-off data bundles do not have an out-of-bundle rate. If the allocated bundle is depleted, data usage will revert to other available data bundles or be consumed at the existing applicable Prepaid out of bundle per MB rate.
    4. Data transfer rates are not guaranteed and are dependent on network availability.
    5. Bundles and tariffs only apply to standard APNs.
    6. Free 30 day once-off data bundles do not apply to data roaming.
    7. No pro-ration is applied, the full bundle will always be allocated
    8. Data bundle balance enquiries will be available via:

Vodacom (Pty) Ltd (“Vodacom”) is running a Vodacom staff competition for the Stand and Suite Ticket for the match between Orlando Pirates vs Kaizer Chiefs taking placing on 1 February 2025 at FNB Stadium, Gauteng (the “Competition”), on Vodacom’s internal platforms

These are the Standard Competition Terms and Conditions that apply to the Competition and comprise Part A (which contains the Competition-specific information) and Part B (which contains general terms and conditions that apply to all competitions). In the event of any conflict, the terms and conditions of Part B prevail.

By entering and/or participating in this Competition, entrants/participants opt into, agree, and consent to be bound by the Terms and Conditions (comprising Part A and Part B) stated below.

Part A: Competition-Specific Terms and Conditions

Competition Duration

  1. The Competition period/duration is from:
    • Start date: 09h00, Monday, 20 January 2025
    • End date: 23h59, Friday, 24 January 2025

Competition Prize/s

  1. The Competition Prize comprises of is: 2 (two) stand tickets per winner to attend the fixture 
    • Total number of Prizes: 15 (fifteen) Vodacom staff winners in total which will be allocated 2 (two) stand tickets per winner  
    • Value of the Prize(s) (per Prize): R 400 (four hundred rand) per person, or as determined by the tournament organiser
    • Prize inclusions: The Prize includes suite tickets, food and beverage in the suite, as determined by Vodacom, and any other gift(s) Vodacom may provide.
    • Prize exclusions: The Prize excludes any and all travel to attend the event and any other costs which may be incurred by the winner to attend the event that falls outside elements provided as part of the prize.
  2. The Competition Prize comprises of is: 2 (two) Suite tickets per winner to attend the fixture 
    • Total number of Prizes: 1 (one) Vodacom staff winner in total which will be allocated 2 (two) suite tickets per winner  
    • Value of the Prize(s) (per Prize): R 3000 (three thousand rand) per person, or as determined by the tournament organiser
    • Prize inclusions: The Prize includes suite tickets, food and beverage in the suite, as determined by Vodacom, and any other gift(s) Vodacom may provide.
    • Prize exclusions: The Prize excludes any and all travel to attend the event and any other costs which may be incurred by the winner to attend the event that falls outside elements provided as part of the prize.

Eligibility

  1. The Competition is open to Vodacom staff members who are permanently employed by Vodacom.
  2. who entered via Vodacom and/or other third-party social media and digital platforms, who completed the competition form, or other stipulated requirements for entry as specified for the Competition.
  3. Eligible entries will be put into the draw and through the process of a randomiser (selected at random), the winner will be selected.
  4. Participants are allowed to enter once a daily for the period of the competition.

Prize Delivery

  1. The Prize delivery for this specific Competition is not applicable.
  2. The general provisions of Part B, in clauses 33 to 45 below, will apply.

Part B: General Competition Terms and Conditions

In addition to the Specific Competition Terms and Conditions outlined in Part A above, the following General Terms and Conditions apply to the Competition.

Duration

  1. The duration of the Competition (as stipulated in Part A above) may be extended, curtailed or cancelled at the discretion of Vodacom.

Prize

  1. Vodacom has the right to change the type and quantity of prize/s (described in Part A above) to determine the value of the Prize/s or to substitute it at their discretion.

Eligibility

  1. Only entries received during the Competition period (as stipulated in clause 1 in Part A above) will be eligible entries.
  2. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded and not eligible to participate in the Competition.
  3. Any entrant/participant under the age of 18 shall present their parent/guardian’s written consent to enter the Competition at Vodacom’s request.
  4. Only entrants/participants who are using SIM cards that have been RICA (Regulation of Interception of Communications and Provision of Communication-Related Information Act) registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
  5. Unless otherwise stipulated, employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
  6. Entrants/participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration.
  7. Entrants/participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
  8. In the event that the user of the mobile phone (i.e., the entrant/participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.
  9. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.

Valid Entry

  1. A Valid Entry must comply with the Competition requirements as stated or described, including as above or on the platforms (social media or other – as selected by Vodacom in its discretion), and which competition requirements may include prompts or instructions for participating in the Competition, (e.g., voting for something, selecting or identifying something or other stated requirement), and/or by completing any required entry forms.
  2. Qualifying entrants/participants must complete all the required information on the Competition entry form or platform, which can be found via Vodacom’s social media platforms during the period of this Competition.
  3. Responses directly or via direct messages on any social media platform will not be considered valid entries.
  4. Only correct answers or a correct sequence of answers will be accepted and eligible to be selected as a winner at Vodacom’s discretion.
  5. Unless otherwise stipulated in or required by the entry requirements, there are no additional charges for participating in the Competition. In respect of online entries, standard data costs may apply to uploading a valid entry online, as may be applicable. Standard data costs apply as per the user’s Service Provider and existing price plan for data usage and are subject to the applicable Terms and Conditions of that service.
  6. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
  7. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.
  8. Vodacom (or its Agent) retains the right to determine, at its sole discretion, if entrants/participants meet the stipulated eligibility criteria, criteria for a valid entry, competition requirements, and may be eligible to win a prize based on the Competition requirements.
  9. Vodacom (or its Agent) is entitled to, in its sole discretion, disqualify any entrant/participant from the Competition for any reason and will not be obliged to notify entrants/participants of such disqualification.

Prize Draw and/or winner selection

  1. The winners of the Prize will be randomly selected from all eligible entries who meet all the requirements set out in these Terms and Conditions, and will be selected at Vodacom’s discretion.
  2. The verified winners will be notified within (2) two days after he/she has been selected and verified as a winner / within one (1) hour after being selected and verified as a winner.
  3. The decision of the judges (who draw the prizes or decide the winners, as appointed by Vodacom at its sole discretion) on any aspect of the Competition, including the award or allocation of the Prizes, will be final and binding and no correspondence will be entered into.

Winner Validation

  1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
  2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, entrants/participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
  3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the entrants/participants to participate in the Competition.
  4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
  5. Should an entrant/participant not be available, or should Vodacom or its Agent be unable to reach that participant for any reason whatsoever, on the contact details provided during the timeframe stipulated above or of the Participant rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived and forfeited. Vodacom reserves the right at is sole discretion to then award the Prize to the next randomly drawn entrant/participant.
  6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants/participants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
  7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required information, documentation or verification from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line.
  8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
  9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to their image and/or likeness being used and published by Vodacom in connection with the Competition for a period of 12 (twelve) months after they have been announced as the winner. The winner may decline the use of their image and/or likeness by Vodacom.

Prize Delivery

  1. The following general conditions apply to the delivery of Prizes.
  2. Vodacom and/or its Agent will determine the mode of Prize delivery at its discretion.
  3. If the method of Prize delivery is identified in Part A above, the clause applicable to that method of delivery as detailed more fully below will apply:
  4. In the event of a Prize requiring physical delivery - delivery will take place via courier at dates, times and places arranged between Openfield and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible or Vodacom’s Agent is unable for any reason whatsoever not to effect delivery, the Prize will be forfeited.
  5. In the event of a Prize requiring physical collection – Vodacom or Openfield Marketing will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Vodacom nor Openfield shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s within 10 (ten) working/business days from the announcement and notification of the winners, failing which the Prize will be forfeited.
  6. In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Vodacom or Openfield has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Neither Vodacom nor Openfield will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
  7. In the event of data and/or airtime Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the Vodacom MSISDN (cell phone number) that the data and/or airtime must be transferred to.
  8. In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification to the satisfaction of Vodacom or its Agents in their sole discretion.
  9. In the event of a Prize being an award on the VodaPay App, the winner must download the App and register on the App. Vodacom can only transfer money into the VodaPay wallet if the the winner has downloaded the App and registered on it. The cash Prize will be transferred into the winner’s VodaPay wallet within seven (7) working days after confirmation by the winner of their VodaPay details. Should the winner fail to meet the criteria for a period of ten (10) working days, the Prize will be forfeited.
  10. Should Vodacom or Openfield not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited – which will be determined at Vodacom’s or its Agent’s sole discretion.
  11. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.
  12. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize for whatsoever reason (including the reasons mentioned above), the Prize will be awarded to the next selected eligible entrant.
  13. All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate.

Prizes are not transferable and right of admission is reserved

  1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
  2. No Prize can be redeemed for cash and may not be sold.
  3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.
  4. Where a Prize is for an event(s) and / or experience(s):
    • It is restricted to the winner(s) of the Prize only. No additional guests will be allowed to enter or have access to the event(s) and / or experience(s);
    • Right of Admission to the event(s) and experience(s) is reserved by Vodacom, its Agent’s or Partners in respect of the event or experience;
    • Vodacom (including its Agent’s or Partners in respect of the event or experience) reserves the right to have a winner (and their partner and / or guest) removed from an event at any time should the behaviour or language of such winner or guest, at the discretion of Vodacom (its Agent’s or Partners in respect of the event or experience), be considered to constitute harassment or be inappropriate, including behaviour or language that is discriminatory or hateful on grounds such as race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth; and
    • Vodacom (including its Agent’s or Partners in respect of the event or experience) reserves the right to remove any winners (and their partner and / or guest) from an event at any time should their behaviour be considered to be dangerous to themselves or any other person or contravening any applicable health and safety requirements.

Undertakings, limitation of liability and indemnification

  1. Event(s) and/or experience(s), to which the Competition Prize relates, may be hosted by third parties (for example, at sport stadia, theatres, convention or other centres owned by other entities). Winner(s) agree to comply with the rules and regulations applicable to events held at such premises upon entry, and as may be stipulated by the owners of such premises.
  2. Entry to any events, experiences, and venues in respect of which Vodacom may give away prizes as part of competitions on its platforms, are bound and regulated by specific event or venue-related rules and regulations, which may be determined by event or venue owners or relevant governing bodies. By participating in this competition, Competition Participants:
    • acknowledge and agree that they are bound by such event, experience, or venue rules upon entry to such premises, event or experience;
    • undertake to adhere to and comply with any and all reasonable event, experience, or venue rules and/or regulations; and
    • indemnify Vodacom, its agents, or employees from any liability associated with Competition participants/winners failure to adhere to such rules and regulations and any damages that occur as a result.
  3. Vodacom, its associated companies, partners, agents, contractors, sponsors, and personnel involved in or associated with the Competition, or a related event or experience shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition, from claiming the Prize, or attending an event or experience forming part of the Prize.
  4. Vodacom (including its Agent’s or Partners in respect of the event or experience) is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
  5. Vodacom (including its Agent’s or Partners in respect of the event or experience) cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize. Should the Prize be linked to a specific fixture, match, event or experience, and should that specific fixture, match, event, or experience be cancelled, interrupted, postponed, or otherwise affected by events or factors outside of Vodacom’s control or at Vodacom’s discretion, Vodacom cannot be held liable for the fulfilment of the Prize or be required to provide an equivalent or replacement Prize.
  6. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.

Personal information and permission to receive marketing and promotional information

  1. User data collected via the Competition will not be used for any other purpose than for the execution of the Competition and/or for the sharing of related marketing and promotional information.
  2. User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy.
  3. By entering this Competition, entrants/participants give Vodacom permission to send them marketing or promotional information about Vodacom products, services and other Competitions, and consent to their name, contact number, and/or email address being shared with official Partner/s in the campaign to which the Competition relates, for marketing or promotional purposes.
  4. The entrant(s) will be given the option to opt out of receiving marketing or promotional information via the platform from which they receive such information.

General

  1. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant/participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  2. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final, and binding, and no correspondence will be entered into.
  3. Vodacom may, at its discretion, refuse to award a Prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
  4. If Vodacom is required to alter or cancel any aspect of the Competition or to terminate it by law, as a result of changes in legislation, or for any reason whatsoever, it has the right to terminate the Competition, with immediate effect and without notice. In such event, all entrants/participants waive any rights they may have against Vodacom and its associated companies, agents, contractors, official Partners and/or sponsors.
  5. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

Terms and Conditions

What is it

Build Your Own Integrated bundles are bundles that offer customers to make a selection of data; voice or social bundles to create their own integrated bundles.

Who can buy

The build your own integrated bundle is available to Postpaid, Prepaid and Hybrid Vodacom customers.

Where to Purchase/Activate

  • The Integrated offers will be available to you through my Vodacom App channel.
  • Bundles can be purchased using wallet, bank cards, Airtime Advance and Combo payment method.

Usage

  1. The bundle will provide you with all access data, voice minutes and social bundles.
  2. The bundle will be available to you from time of confirmation of purchase and valid for the specified period determined by your selected bundle validity period (e.g. 1, 3, 7 or 30 days)
  3. One day bundles are valid from time of confirmation of purchase until midnight (23h59:59) of the same day
  4. Once the bundle is depleted and you wish to continue using voice or data services, you shall do so as per your existing tariff plan rates until such time as you purchase additional bundles
  5. You can check your bundle balances by using my Vodacom App or by dialing *135#, and choosing option 1 – balances
  6. There will be no carryover following the expiry date of said bundle
  7. If a customer changes payment type from Prepaid / Hybrid to Post-paid the remainder of their bundle will be forfeited
  8. The bundle is available for use in all compatible smartphone devices and tablets

Termination/Limitation of Services

  1. Vodacom reserves the right to terminate or change the service at any time
  2. You may only use the service for personal use. You may not use the service for commercial purposes nor may you use it to set up as a personal hotspot. Vodacom reserves the right to suspend the Service if in the opinion of Vodacom, you misuse or abuse the Service in any way whatsoever.
  3. In the event that any of your user data is collected whilst using Service, the user data will be stored for as long as Vodacom is legally required to and in accordance with Vodacom's Privacy Statement, https://www.vodacom.co.za/vodacom/terms/privacy-policy. If there is no legal requirement, the collected information will only be stored for as long as it is needed for Vodacom to be able to provide the Service and has a legitimate interest in processing such user data.
  4. Vodacom reserves the right to terminate the Services immediately and without notice to you in the event that the Service is held to be or becomes unlawful in terms of applicable laws. In such event you hereby waive any rights which you may have against Vodacom and acknowledge that you will have no recourse or claim of any nature whatsoever against Vodacom
  5. Vodacom reserves the right to amend these terms and conditions and where such change is material, Vodacom shall provide you with reasonable prior written notice before implementing any such change
  6. Vodacom makes no warranties, expressed or otherwise through its employees or agents unless such warranties are reduced into writing and contained in these Terms and Conditions

Overbuild and Low Uptake Precincts

Vodacom Fibre Broadband Services Promotional Offer

These terms and conditions shall only apply to the Vodacom Fibre Broadband Overbuild and Low Uptake promotional offer as defined below. The promotional offer consists of:

  • Reduced monthly subscription charges for Qualifying Subscribers that sign-up for new or renewal of existing Vodacom Fibre Broadband Services on a month-to-month fixed-term agreement (as defined in the Standard Vodacom Fibre Broadband General Terms and Conditions).
  • The applicable reduced monthly charges are set out in the table below:

  • The reduced monthly subscription charges shall be effective from the date that the Qualifying Subscriber’s account is activated or renewed, and the effective promotional period shall be for a duration of twelve (12) months thereafter (“Effective Promotional Period”).
  • At the end of the Effective Promotional Period, the Qualifying Subscriber shall be liable for the standard subscription charges that are applicable for the relevant fiber package. For avoidance of doubt, the Qualifying Subscriber will be charged the prevailing Vodacom rates from month 13 (thirteen) onwards which relate to the relevant fibre package (“Promotional Offer”).

Conditions to the Promotional Offer

  • The Promotional Offer is subject to a successful credit vetting and conclusion of a new or renewed fixed-term Subscriber agreement for a month-to-month agreement.
  • Renewals and Migrations are eligible for the Promotional Offer if the precinct qualifies for the promotion, as determined by Vodacom in its sole discretion.
  • The Promotional Offer is available through the Vodacom Fibre Self Build Network only to the Specific Precincts identified by Vodacom business as overbuild or low uptake.
  • The reduced monthly subscription charges shall be pro-rated, depending on the activation date of the Subscriber’s Promotional Offer; that is, the customer will be billed less the discount value from the billing activation date until the end of the Effective Promotional Period.
  • Qualifying Subscribers are required to place their orders for Vodacom Fibre Broadband Services up to the 30th July 2024, thereafter the Promotional Offer will be discontinued. For the avoidance of doubt, the Effective Promotional Period shall be calculated from the date that the Promotional Offer is activated for a relevant customer which date must be before 30th July 2024. In other words, the 12 months discount period will begin from the day the fibre service is active or renewed.
  • For the purposes of this Promotional Offer:
    • Migrations” shall have the same meaning in the Standard Vodacom Fibre Broadband Services Terms and Conditions (see link below);
    • Qualifying Subscribers” shall mean a customer who has been successfully credit vetted and is residing in the Selected Precincts; and
    • Selected Precincts” shall mean the areas, locations or precincts which qualify for the Promotional Offer, as determined by Vodacom in its sole discretion, and are subject to change.

Standard Vodacom Fibre Broadband Services Terms and Conditions

EDCON GROUP: MERCHANT TERMS AND CONDITIONS

  1. The bearer of the Edcon Gift Card may use the Card to purchase merchandise from any Edgars, Edgars Active, Red Square, Jet, JetMart, Legit, Boardmans and CNA stores.

  2. The Gift Card is valid for a period of 3 years from date of activation or upon full redemption thereof, whichever occurs first. If such gift card has been topped-up, it will remain valid for a period of 3 years from date of top-up or upon full redemption thereof, whichever occurs first - irrespective of the date of activation.

  3. The Gift Card may not be (1) used for the payment of an Edcon account; (2) exchanged for cash; or (3) used to purchase airtime.

  4. No cash change will be given on purchases made with the Gift Card.

  5. For security reasons, this Gift Card should be kept in a safe place. If stolen, it may still be used to make unauthorised / fraudulent purchases. 

  6. Lost or stolen Gift Cards will not be replaced or refunded. However, if you are in possession of the gift card number, you can call the Edcon Gift Card Centre on 0860 692 274 to report it lost or stolen, we will then block the remaining amount on the Gift Card and transfer it to another Gift Card, available when you next visit any Edcon Store.

Electronic Gift Card Terms and Conditions

 An electronic gift card is an SMS version of the existing gift card and the following additional terms apply:

  1. If the full value of your Electronic gift card is not used on your first purchase, the balance will be transferred to a physical gift card.

  2. The Electronic Gift Card cannot be topped up or be SMS'd to someone else. 

  3. Should the Electronic gift card be deleted or the Customer's cellphone lost/stolen, Edcon will be not be liable for any reimbursement of any nature. The SMS can be resent, but only to the original number.

  4. The usage of the Electronic gift  card is solely at the risk and discretion of the Customer

  5. Edcon will not be held responsible for any cellular network service operator's delay in forwarding an Electronic Gift Card to you

  6. The Electronic gift card will only be accepted if a valid Electronic gift  card number in SMS format is presented to the Cashier 

 

FLOOK SPORT & TRAVEL DEALS: MERCHANT TERMS AND CONDITIONS

By using the www.flook.co.za website, you agree to be bound by the Flook terms and conditions in force at the time of using the website.

  1. You will need to register with Flook order to make a purchase or redeem a prize coupon on the Flook website.

  2. Flook is committed to conduct business on the applicable principles of the Consumer Protection Act 68 of 2008 ('CPA') and Electronic Communications and Transactions Act 25 of 2002 ('ECT Act').

  4. DELIVERIES & RETURNS

    DELIVERIES:

    2. Physical goods will be delivered, by courier, to the delivery address specified by the buyer on the checkout form. It is the buyer's responsibility to ensure that there is someone at the shipping address during office hours, to receive the delivery.

    3. Experiences / virtual goods, in the form of coupon/s redeemable by the purchaser at the resort/golf course, are emailed to the buyer as soon as payment has been made and confirmed.

    4. Delivery time may differ depending on size, weight, availability etc.

    5. Once payment of an order has been made, an email will be sent to the buyer, providing key information including the estimated delivery date of the order. 

    6. Take note: The product is only reserved for 20min before it is released back into stock again if payment / prize coupon hasn't been received/redeemed. First come, first served. 

    7. If Flook is unable to meet the estimated delivery date we shall not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

    8. Flook will, occasionally on a promotional basis, offer free or reduced-cost delivery as is the case for Vodacom Prize winners.

    9. Flook does not deliver to Post Office boxes.   

    10. If you buy multiple products within one order, they may be sourced from different vendors. If these vendors are in different locations, delivery time may be longer.

  5. RETURNS

    1. Requests for returns or exchanges must be logged within 7 (seven)  working days of the delivery date.

    2. Item/s must be in a re-sellable condition and in their original packaging, with labels attached.

    3. Request a return or exchange by emailing your order number, the details of the item/s in question, along with an explanation of why you would like to do so, to [email protected]

    4. Our couriers will contact you to arrange a suitable time and day to collect. A collection takes up to 5 working days.

    5. The following items are not returnable / exchangeable

      3. Sporting equipment/apparel that has been used since taking delivery

    6. Return and exchange requests will be approved at the sole discretion of Flook.

    7. Once return or exchange has been approved, there is no cost to the customer. 

    8. Products will not be eligible for return if they have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods or property. This includes products that have been worn or damaged.

    9. Except in the case of a defect, we will not accept returns of shoes that have been worn. A separate box must be used to ship shoes/trainers back with the original box inside. The original box cannot be used as packaging for shipping.

    10. Once a request for a return has been logged and approved by Flook, you will be sent an email to confirm that our courier partner will arrange a collection date and time with you.

    11. Please ensure that the item/s is/are in the packaging that you received them, and that you include the original order invoice.

    12. Collection and return to our warehouse can take up to 4 working days for main centres, and 8 working days for outlying/regional areas from the date of logging a return.

    13. You may select whether you would prefer to be refunded by way of cash (refund made to the card used to make the purchase) or by way of a Flook coupon (a code given to use on our site anytime in the future).

    14. A Flook coupon can be redeemed immediately on our site, while card refunds may take up to 10 working days to be processed.

    15. In the case of incorrect/damaged/faulty/late goods - exchanges or replacements are the responsibility of Flook and the relevant supplier. Please notify us of such products within 3 days of receipt of your order.

Please take a moment to read these Terms and Conditions to understand how they apply to your use of the website and any products or services that you may order online.   2. Defects, Returns, Refunds & Guarantees

    1. Should you not be satisfied with your product purchased by from us by reason of a defect, incorrect choice of product, or otherwise, you may, under certain circumstances, be entitled to either be refunded or have the product repaired or replaced. As a valued customer, we shall at all times endeavour to provide you with the best customer service and ensure that all your rights in terms of the Consumer Protection Act are protected.   15. Payment Options

    1. Incredible Connection Products, Price & Availability

      1. All pricing displayed on the website is inclusive of the current South African VAT, is in South African Rands Only and is subject to price changes and may change without any warnings or notifications. Stock availability Stocks of all goods on offer are limited. Incredible Connection shall take all reasonable efforts to ensure that when stock is no longer available, that offers thereof are discontinued. However, should Incredible Connection be unable to fulfil any order placed by you at the advertised price due to stock having sold out, Incredible Connection will notify you and you will be entitled to a refund of the amount paid by you for such product, as explained in more detail in the Refund Policy ("Refund Policy") Should a product become Sold out we will have the right to cancel your order and refund you your payment including any applicable delivery fees, we cannot supply products that have been marked as sold out.

      2.       5. Errors Incredible Connection shall take all reasonable efforts to accurately indicate prices and delivery charges. However, should products be erroneously offered at incorrect prices and/or delivery charges, Incredible Connection will not be obliged to sell products at such incorrect prices and/or delivery charges, but shall refund monies paid by you should you not wish to proceed with the purchase at the correct price and/or delivery charge.

    5. Payment Methods

      Subject to the exceptions listed below, your payment for any products ordered from Incredible Connection must be made to Incredible Connection's bank account in any one of the following ways:

      1. Credit card payments

        1. The website only accepts (3D Secure) South African bank issued Credit Card payments which include Visa and Master card. At the time of placing the order, the transaction details are presented to the bank for authorisation immediately. If bank's authorisation is not obtained, the order will be cancelled. Payment is not collected immediately it is a reserved for payment transaction. Only when the order is settle by incredible connection are the funds collected. Please note that Master Card Cheque and Debit Cards are not accepted.

        2. 3D Secure: We are proud to introduce a more secure online shopping experience for you! Registration with 3D Secure is required when shopping online with us as a 3D secure merchant and no username and password to remember anymore. You will now receive a One-Time-Password (OTP) that will only be valid for one transaction when shopping at a 3D Secure merchant, protecting your Credit Card against fraudulent online use. We all love the convenience of shopping online, but are concerned about the risks that may be involved. This is why we a deploy technology, such as 3D Secure, which has been designed to protect you while you shop.

      2. Bank deposits & Electronic Funds Transfer 

        Should you select to pay via a bank deposit or Electronic Fund Transfer: on completion of your order an instruction will be emailed to you regarding the acceptable methods in which monies must be deposited into Incredible Connection's bank account which is subject to the following Terms and conditions:

        1. the full amount must be paid as per your order request within 48hours of placing your order;

        2. your order will be cancelled should you fail to deposit/transfer the funds within 48hours of placing your order

        3. for a direct deposit, the deposit must be in cash and in SA Rand only, (no other currency will be accepted)

        4. No cheque deposits are accepted

        5. your order number must be used in the reference section of the deposit slip or the electronic transfer, failure to include the order number as a reference may result in delaying the fulfilment of your order

        6.  please email a copy of your deposit slip/transfer to [email protected]

        7. your delivery timeframe is dependant and will commence on the time and date of the funds reflecting in Incredible Connection's account and on condition that your deposit slip has been mailed to [email protected]

        8. depending on the bank, some payments may take up to three business days to reflect in our account. In such circumstances there will be a delay in having your order shipped

      3. Click and Collect, Pay and Collect Instore

        Should you select the Click and Collect option on completion of your order an instruction will be emailed to you. Please allow the store to check that your items are ready for collection. You will receive a "Ready to collect" email when your order is Ready for you to pay and Collect. Please pay and collect your order within 48hours after receipt of the "Ready to collect" email notification. Orders will be cancelled if not paid for and collected within 48 hours after receipt of the "Ready to collect" email notification.

      4. EFT Pro:

        1. On the successful completion of your EFT Pro you will receive an order confirmation email.

        2. When paying using PayU EFT Pro, the communication between you and your bank occurs as it normally would when you conduct an EFT.

        3. You will be redirected to the online banking login screen and will be prompted to login with your online banking credentials.

        4. You will receive a one-time pin which you would need to enter to confirm payment.

        5. The EFT must be in SA Rands (ZAR) only (no other currency will be accepted.). Incredible Connection cannot be held liable for any delays, cost associated to bank / admin charges and currency fluctuations.

        6. PayU EFT Pro merely facilitates the transaction between you and your bank. PayU does not store any online banking login details.

        7. Your delivery timeframe is dependent and will commence from the time and date of the successful EFT Pro confirmation (please refer to our delivery timeframes T&C's for info).

    6. Deliveries

      1. Incredible Connection delivers within the borders of South Africa only.

      2. The Delivery option only commencers once the order has been verified and settled

      3. An order will only be settled once payment has been received and "Verified"

      4. Deliveries are door to door and must be a physical address within the borders of South Africa and not a Post Box We do not deliver to any postal addresses ie: deliver to a post box or to any post offices. Please ensure all delivery details including the postal code are accurate, as you will be liable for all additional handling and shipping charges as a result of such errors.

      5. Deliveries are done between 8 am and 5 pm on weekdays and not on Weekends or public holidays

      6. All deliveries are done by RAM Hand-to-Hand Couriers or a techxpert agent.

      7. ID may be requested upon delivery

      8. Same day delivery; This service is available throughout South Africa to Major Centres and will be affected by the same business day, (Monday to Friday, excludes weekends and public holidays) on condition that your order is placed and payment has been received before 10h00.

      9. A delay of up to 24 hours may be experienced on shipments to or from any Outlaying Delivery Areas. Should you live in an outlying area it may be more suitable to choose overnight or an economy delivery service

      10. Overnight: This service is available throughout South Africa to Major Centres and will be delivered, (Monday to Friday) on condition that your order and payment confirmation is received before 12h00. Orders received after 12h00 on a Thursday will be delivered on Monday and orders received after 12h00 on a Friday up to Sunday will only be delivered on the Tuesday thereafter. Overnight Deliveries excludes weekends and public holidays, and when an order has been placed on or before a weekend or public holiday. A delay of up to 24 hours may be experienced on shipments to or from any Outlaying Delivery Areas.

      11. Economy: This service is available throughout South Africa to Major Centres and will be affected within 3 to 5 working days, (Monday to Friday, excludes weekends and public holidays).

Next Day Deliveries excludes weekends and public holidays, and when an order has been placed on or before a weekend or public holiday. A delay of up to 24 hours may be experienced on shipments to or from any Outlaying Delivery Areas.

    7. Purchasing Televisions.

  16. Pre-Order Terms And Conditions

    1. Application of terms and conditions. The terms and conditions laid out herein applies to all items pre-ordered online at Incredible Connection (www.incredible.co.za), and is subject to our standard Terms & Conditions as listed on this website. You, the Customer, enters into the following 'Pre-Order' agreement with Incredible Connection a division of Connection Group Holdings Limited Reg No:1997/005390/06:

    2. The Spirit of Fair Play. Because we pride ourselves in our customer service, diverse range of products and ability to meet the ever-growing consumer demands, we have allowed the pre-ordering of products on our website. The pre-ordering system essentially gives customers peace of mind that newly launched products can be secured before the official launch date thereby avoiding disappointment on or after the day. There are however times when unethical customers may try to take advantage of us and/or our systems so it is necessary to lay down the ground rules so that arguments can be prevented and/or resolved. We therefore would like to officially lay down the following ground rules for pre-ordering.

    3. Minimum Deposit. A minimum deposit (as advertised on the website) will be required for pre-orderable items from time to time. Pre-orders must be secured with 100% upfront payment, before delivery. A pre-order is considered secured only when the appropriate amount for deposit or full pre-payment is made. "Secured" means that we will to the best of our ability attempt to secure the relevant stocks, to fulfil the order. It does not mean that pre-orders will be fulfilled 100% of the time, as occasionally there are circumstances beyond our control, but rest assured that we will fulfil all pre-orders 99.9% of the time.

    4. Settling the Balance. Please be advised that Incredible Connection will be contacting you prior to the launch date to arrange for the settlement of the outstanding balance as per the advertised purchase price. We do however urge our customers to pay the full purchase price up-front so as to avoid the potential inconvenience of settling the outstanding balance before the launch date.

    5. Maximum order quantities. To protect our Customers from unscrupulous elements who attempt to profit from limited stock and market demands, we restrict Customers' pre-orders to a limited number of units per product ordered. This ensures that everyone gets their fair share.

    6. Pre-order status. All pre-orders are subject to stock availability. Sometimes manufacturers and suppliers are unable to stick to a delivery schedule and sometimes they are unable to fulfil their promise on quantities. However, to the best of our ability, we will only work with dependable, reliable and timely suppliers to protect your interests. Fortunately, these incidents are few and far between. For items for which severe shortage occurs, we will revert to the fairest basis which is first-pre-ordered, first-served. So it always pays to be quick and decisive when it comes to pre-ordering. Please note that the expected launch dates are subject to change at the manufacturer's discretion.

    7. Changing your pre-order or cancelling it. In the event of changes to the advertised pricing, features or product offerings, the Customer will be notified and given an opportunity to continue, cancel or amend his/her pre-order. Refunds, changes and cancellations will only be possible for pre-orders that haven't been shipped to the Customer. Please allow for a potential variance, between the estimated pre-order price and the actual final retail price. The variance is usually applicable to imported items for which foreign freight, currency exchange rate fluctuations and of course, taxes. This usually works both ways, both for price increases and lower prices, subject to the final expenses incurred in importing the items.

    8. Deliveries & Part Shipment. Deliveries of pre-orders will generally be concluded within 72 hours of the advertised launch date, we will however endeavour to have your product delivered as close to the advertised launch date as possible, ensuring that you are one of the first to have the product. In the event of part shipment (partial shipment) as requested by the Customer, he/she will be liable for all the associated delivery charges.

    9. Collecting your pre-order. Customers will be permitted to collect their pre-orders at their self-appointed store.

    10. Returns, Refunds and Exchanges. Incredible Connection reserves the right to provide refunds for orders that it no longer wishes to support/accept/fulfil. Please refer to the Returns, Refunds & Exchange Policy as listed on our website.

    11. Determination of policies. At all times, Incredible Connection reserves the right to make any changes on all amendments, descriptions, updates, variations, assortments/bundles, prices, discounts etc., as it may deem fit, at its own discretion.

    12. Applicability. Incredible Connection will enforce all policies stated on its website at all times. Customers are advised to be mindful of the rules and regulations, terms and conditions of their purchases as per the policies listed here.

Ster-Kinekor Theatres a division of Primedia (Pty) Ltd. and/or each and any of its respective members, employees, contractors, sub-contractors, agents, workmen or representatives (hereinafter referred to as "the Company") do not accept responsibility or liability for any damage, loss, claim, or other liability or expense of whatever kind or nature, - consequential, special, or otherwise - whether for death, personal injury, loss, damage to property or otherwise, including but not limited to medical claims & legal expenses, regardless whether such injury, loss or damage results from the negligence or wilful act of the Company or from any other cause whatsoever and any person entering these premises and any parent and/or guardian of a minor child entering the premises hereby indemnifies the Company against any such claim as aforementioned and from any cause whatsoever that may be instituted against the Company. 

  2. All customers enter our premises at their own risk. 

  3. Each e-voucher can only be used once by the person to whom it is issued for admission & is redeemable at any Ster-Kinekor Theatres in South Africa except Cine Prestige, IMAX and for any movie except 3D movies. 

  4. Each e-voucher can be redeemed at the ticket counter and SST's (self-service terminals) but not via Ticketline, or the Ster-Kinekor Theatres web or mobi sites. 

  5. Each e-voucher is valid for 3 (three) years and will expire on redemption or on the stipulated expiry date, whichever is the earlier. 

  6. The person to whom the e-voucher number and/or password is issued is responsible for its safe-keeping. Lost or stolen e-vouchers will not be replaced. This may include inadvertent deletion, forwarding or access of the correspondence containing the e-voucher. 

  7. E-vouchers will not be accepted if the e-voucher number is invalid or cannot be found within the Ster-Kinekor Theatres system. 

  8. The e-voucher cannot be utilised in conjunction with any other special, promotion and/or discount and /or any club offerings. 

  9. Only authorised e-vouchers will be accepted.

  16. Food which has not been purchased from Ster-Kinekor Theatres' concessions counter on the specific premises may not be brought into or consumed on those premises. Only food/drinks purchased at the specific premises may be consumed within the premises. In cinemas where Ster-Kinekor Theatres sells alcoholic drinks, these may only be consumed within the licensed area. Customers are required to observe all 'No Smoking' restrictions and the smoking regulations. 

  17. Customers accept and acknowledge that due to the nature of Ster-Kinekor Theatres' business, the cinemas will not be properly lit during a performance. Further, walkways and stairways may not be lighted after the stated starting time of-, and during, a performance. Customers hereby indemnify Ster-Kinekor Theatres for any injury or loss resulting from their failure to be seated prior to the stated starting time of a performance and for their failure to remain seated for the duration of a performance. 

  18. Save where no specific allocation is made, customers must ensure that they sit in the seats that have been allocated to them. If a customer refuses to sit in his or her allocated seat, Ster-Kinekor Theatres' management will be entitled to insist that the customer leave our premises. 

  19. It is your responsibility to be aware of and to adhere to age restrictions that are applied to films and/or events.

Product availability

All images, descriptive matter, specifications and advertising on our virtual marketplace are for the sole purpose of giving an approximate description of the products. Due to the nature of the flowers and florist's handiwork, final delivered items may differ from the images shown on this virtual marketplace due to non-availability; the delivering florist may also substitute flowers, greenery, filler, container or accessories without notice to the Customer.

Order processing

Order processing begins when we receive a confirmed order and full payment. When orders are placed on a weekend or public holiday the order will be processed on the next working day.

Pricing and Payment Options

All transactions will be processed in South African Rands (ZAR). SA Florist endeavours to offer you competitive prices on current products; your total order price will include the price of the purchase plus any applicable sales tax and delivery charges (on the day of delivery). SA Florist reserves the right to change pricing at any time without prior notice.

Payment for products on the virtual marketplace may be made by Credit Card, by Electronic Fund Transfer (EFT) or by Direct Deposit.

Delivery

Delivery time is dependent on product stock availability.

Orders will be delivered any time between 9 am and 5 pm. Any specific delivery times requested on an order form cannot be guaranteed.

When orders are placed on a weekend or public holiday, the order will be processed on the next working day. Same day deliveries are not guaranteed. Should we have stock available, orders will be dispatched on the same day provided payment is validated/received before 13h00 on the day.

Every effort is made to effect delivery of your order timeously, however, unforeseen circumstances may cause delays. Should we be faced with such an occurrence, SA Florist will contact you via email and provide a revised delivery schedule.

Our rule of thumb is that if an address cannot be found on a standard GPS then we reserve our rights to make alternate arrangements with the recipient to ensure that the product is delivered to them.

If any of the details you have given us in your delivery address are incorrect, we are not liable for any items which are not received.

You agree that if a recipient is unavailable at the given address, the delivering outlet can leave the product with a neighbour / co-worker / leave a calling card / leave a voice message or coordinate with the recipient to re-attempt delivery, depending on what is most applicable to the circumstances.

If the delivery person is not allowed to deliver the flowers or gifts directly to the recipient for orders to be delivered to hospitals, hotels and business addresses, the delivery will be left at the reception desk, which will constitute successful delivery.

Refunds/Returns Policy

When payment has been made, your right to a refund is limited by our Terms and Conditions.

In the event that we are unable to supply the flower product ordered or any substitute flower product, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and no later than 30 days after the intended delivery date.

Neither ourselves, nor any courier or carrier service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances outside of our reasonable control; these circumstances to include but not be limited to any adverse weather conditions such as snow, flood, extreme winds, fire, explosion, accident, traffic congestion, obstruction of any private or public highway, riot, terrorism, act of God, or from any industrial dispute or strike.

In the event of a complaint, SA Florist and its affiliates reserve the right to refund or replace depending on the circumstances, provided that the complaint was reported within 36 hours  from 5pm on the requested delivery date.  Due to the nature of flowers and the responsibility of the recipient to care for them once delivered, no complaints will be accepted after this deadline has been reached. Complaints must be accompanied by a photograph of the product that is the cause of the complaint.

Vouchers, Coupons, Promotions & Competitions

SA Florist reserves the right to withdraw any and all discount vouchers, promotional offers or discount bundles issued by ourselves without any prior notice or compensation offered. Our vouchers do not carry a cash value and cannot be exchanged for cash. We reserve the right to suspend your account or voucher should we suspect fraudulent activity. R50 off vouchers can only be used once and are only valid if you have "liked" our Facebook fan Page. Promo vouchers are only applicable to Arrangements, Bouquets and Hamper orders that exceed a value of R200 (excluding delivery) and can only be used once. SA Florist 's decisions are final and no negotiation will be entered into in this regard.

TERMS AND CONDITIONS FOR SAFLORIST SOCIAL MEDIA COMPETITIONS.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST (or the "Promotion"). A purchase will not improve chances of winning. By entering this Promotion, entrants accept and agree to be bound by these Terms and Conditions. You have not yet won. Winning a prize is contingent on fulfilling all requirements set forth in these Terms and Conditions. Any violation of these may result in disqualification, without notice to the violator. All decisions of the Sponsor are final and binding in all respects.

  1. All SAFLORIST promotions or competitions are in no way sponsored, endorsed, administered by, or associated with Facebook, Google +, Instagram, Pinterest, Twitter or YouTube. You are providing your information to SAFLORIST and its partners and not to the abovementioned. The information you provide will only be used for marketing and to contact you if you are a winner. All marketing correspondence has the option to opt out at any time.

  2. Social Media winner announcements will be made on a date specified for each competition. The winners will be chosen based on the relevant competition terms and conditions.

    The selected winners will need to agree in writing upon winning the prize to at least two of the following options: three (3) Facebook posts with images, three (3) Tweets or three (3) Instagram posts, tagging both SA Florist and in all posts and tweets.  Should a winner only have one of these social media platforms in use, the amount will increase to six (6) Facebook post or tweets or Instagram posts. The prize will be automatically forfeited should this not be agreed to in writing beforehand.

    If a potential winner cannot be located or does not respond within fourteen (14) days, the prize will automatically be forfeited. Except where prohibited, acceptance of prize constitutes winner's consent to the use of his/her name, likeness and biographical data for advertising and promotional purposes without additional compensation. Prize is not redeemable for cash.

  3. Eligibility: NO PURCHASE IS NECESSARY. Entrants of all ages can enter but any destination prize winner(s) under the age of 18 must be accompanied by an adult on their destination prize trip. This promotion is open to residents worldwide except for the following and their employees, contractors and their families of SA Florist.

    All national, provincial and local laws apply. Void where prohibited. All state and local taxes are the winner's sole responsibility. By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs to redeem said prize and any and all liability that might arise from redeeming or seeking said prize.     Entries displaying or containing profanity or that are obscene, and all incomplete entries, will be disqualified and/or deleted. Entries found to be part of link exchanges, liking vote engines will be disqualified and/or deleted.  SA Florist will act as moderators of the user-generated content and will exercise discretion in their performance thereof. The user-generated content may be used by SA Florist across all of SA Florists online properties - including SA Florist's various Social Network platforms - and all entrants give their express permission for SA Florist to do so. Entries must meet all relevant eligibility requirements listed herein. SA Florist's decision on the winners will be final. The only entries that will be considered as valid are those entered during the relevant competition period and which satisfy the abovementioned criteria. No entry will be accepted or deemed valid if it is submitted through any other means. Only completed entries will be eligible for the prize.

    All entries received after the end of the Promotion Period will be void and will not be eligible for the prize. Entry materials are automatically null and void if not obtained through the authorized channels or if any part is late, incomplete, illegible, or contains typographical or other errors. Vodacom United Rugby Championship Mascot Run Out Competition

Terms and Conditions

Vodacom (Pty) Ltd (“Vodacom”) is running the Child Mascot Run Out Competition for select Vodacom United Rugby matches that will take place in South Africa related to the following participating teams, Vodacom Bulls, DHL Stormers, Emirates Lions and HollywoodBets Sharks (the “Competition”) on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms.

These are the Standard Competition Terms and Conditions that apply to the Competition and comprise Part A (which contains the Competition-specific information and terms and conditions) and Part B (which contains general terms and conditions that apply to all competitions). In the event of any conflict, the terms and conditions of Part B prevail.

All Competition participants agree to be bound by the following Terms and Conditions (comprising Part A and Part B).

Part A: Competition-Specific Terms and Conditions

Competition Duration

  1. The Competition period/duration is from:
    • Start date: 09h00, 16 September 2024.
    • End date: 23h59, 30 June 2025.
  2. Prize Draws are fixture-related and will be done before the relevant match for each Competition within the 2024/25 season or as communicated via social media platforms.

Competition Prize/s

  1. The Competition Prize is: a Vodacom customer can win one (1) spot for their child (‘Child Mascot’) to run out onto the field with a participating Rugby team(s) (as specified via Vodacom’s social media and digital platforms), at the selected/specified game. 
    • Total number of Prizes: 1 (one) run-out spot for the match or (as specified via Vodacom’s social media and digital platforms.
    • Value of the Prize(s) (per Prize): approximately R 1000 (one thousand rand) (non-exchangeable or refundable as the prize relates to the experience that can be won)
    • Inclusions: 4 (four) stand tickets, 1 (one) T-shirt, 1 (one) white short and a pair of socks will be provided to each winning customer/their child who runs out with the team.
    • Prize exclusions: All travel related to attending this event, and any expenses of a personal nature related to attending this event, e.g. tekkies / sneakers for the child to run in.

Eligibility

  1. The Competition is open to Vodacom customers on a contract, who have been Vodacom customers for an uninterrupted period of over 24 (twenty-four) months or longer, and who entered via Vodacom and other third-party social media and digital platforms and completed the competition form.
  2. Participants are allowed to enter the Competition once per day during the Competition period or as specified in the relevant social media campaign posts.
  3. The age of children who can win an opportunity to participate in the Child Mascot run out Competition is restricted to the ages between six (6) and thirteen (13) years old. Vodacom reserves the right to ask for the birth certificates of the winning child and the parent or legal guardians’ identification (or confirmation of the parent/guardian – child relationship) for verification purposes.

Child Mascot Specific Terms and Conditions

  1. By entering this Competition, the Vodacom customer entering and participating in this Competition (as the parent or legal guardian of a potential participating Child Mascot) accepts the terms and conditions of this Competition and accepts the application of such terms and conditions to their child who they wish to enter to participate as a Child Mascot.
  2. By accepting the Prize, and by virtue of the nature of the Prize, the parent or legal guardian agrees (on behalf of their child) that the image of the child will be displayed on multiple media, social and digital platforms in relation to the event and that there will be no compensation related to the child and/or parent / legal guardian for the usage of the image of the child.
  3. The child and his/her parent or legal guardian will be required to meet at a specific time and venue on match day. All details will be provided by Vodacom. Should the child and his/her parent or legal guardian not be able to be at the stadium at this time, the Prize will be forfeited.
  4. The child will run out onto the field as a Child Mascot and will accompany and run out with the captain of a playing Vodacom URC team or its Mascot, by holding the Captain’ or the Mascots’ hand. By entering this Competition, the Vodacom customer accepts and consents to all activities and requirements reasonably necessary for the Child Mascot to run out with a team.
  5. Vodacom or its Agent retains the discretion to decide with which of the participating teams the Child Mascot will run out with, and their decision is final. If the parent or legal guardian does not agree with that decision, the prize will be forfeited.
  6. Vodacom or its Agent will communicate all other practical requirements applicable to the day of the event to the parents or legal guardian (e.g., collection of the child after the run out), which the parents or legal guardian agree to follow by accepting these terms and conditions.
  7. The child will be provided with a shirt, shorts, and a pair of socks, that he /she is required to wear during the run out. The parents or legal guardian must supply the child with tekkies / sneakers for the child to run out in.
  8. The parent or legal guardian that accompany the child will be required to sign a Vodacom indemnity form prior to the event taking place. Should the parent or legal guardian fail to provide Vodacom with a signed indemnity form, the Prize will be forfeited. The Vodacom indemnity form shall be provided 3 (three) days prior to the event.
  9. By entering this Competition, and/or by signing the required indemnity form, the Vodacom Customer/entrant warrants their authority to sign any such indemnity and warrants that he/she is the parent or legal guardian of the child.
  10. The parent and /or legal guardian shall at all times during the child’s participation as a Child Mascot remain responsible for the child, including his/her health, safety, and well-being, and shall be responsible to clearly communicate any special requirements or needs of the child (for example, allergies, dietary restrictions, or other health-related requirements etc) to Vodacom or its Agent.
  11. Vodacom, or its Agents, retains the sole discretion - should there be any reason whatsoever that the child cannot or should not run out with the participating teams - to not let the child run out with the team (for example, due to any misbehaviour or anxiety or if it is deemed not to be in the child’s best interest). Vodacom or its Agent will not be liable for any replacement prize in this event.
  12. Vodacom are bound by all rules and regulations that are determined by SA Rugby, United Rugby Championship, Glasgow Warriors, Blue Bulls Company related to this fixture. These rules will apply to all the child, parent, legal guardian or other chaperones/attendees (attending with the child and his/her parent or legal guardian who will be attending which will be communicated by Vodacom to the parties.

Valid Entry

  1. The Competition is only open to Vodacom customers who have entered via Vodacom and other third-party social media and digital platforms and completed the competition form.
  2. Qualifying entrants must complete all the required information on the Competition entry form, which can be found via Vodacom’s various social media platforms during the period this Competition is running.
  3. Responses directly or via direct messages on any of the social media platforms will not be considered as a valid entry.
  4. Only correct answers or sequence of answers will be accepted.
  5. Participants are allowed to enter only once.

Prize draw

  1. The winners of the Prize will be randomly selected from all eligible entries who meet all the requirements set out in these Terms and Conditions.
  2. The verified winners will be notified within (2) two days after he/she has been selected.

Prize Delivery

  1. The tickets related to the Prize for this specific Competition will either be delivered physically or electronically via email as contemplated in clauses 1 and 25.3 below.

Part B: General Competition Terms and Conditions

In addition to the Specific Competition Terms and Conditions outlined in Part A above, the following General Terms and Conditions apply to the Competition.

Duration

  1. The duration of the Competition (as stipulated in Part A above) may be extended or curtailed at the discretion of Vodacom.

Prize

  1. Vodacom has the right to change the type and quantity of prize/s (described in Part A above) or to substitute it at their discretion, and Vodacom has the right to determine the value of the Prize/s.

Eligibility

  1. Only entries received during the Competition period (as stipulated in clause 1 in Part A above) above will qualify as potential winners.
  2. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded from participating and winning in the Competition.
  3. Any participant under the age of 18 shall present their parent/guardian’s written consent to enter the Competition at Vodacom’s request.
  4. Only entrants who are using SIM cards that have been RICA registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
  5. Unless otherwise stipulated in Part A, employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
  6. Participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration, and provide a copy of such an identity document to Vodacom on request - failing which eligibility to win is forfeited.
  7. Participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
  8. In the event that the user of the mobile phone (i.e., the participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.

Valid Entry

  1. Unless otherwise stipulated in or required by the entry requirements in Part A, there are no additional charges for participating in the Competition. In respect of online entries, standard data costs may apply to uploading a valid entry online, as may be applicable. Standard data costs apply as per the user’s Service Provider and existing price plan for data usage and are subject to the applicable Terms and Conditions of that service.
  2. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
  3. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.

Winner Validation

  1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
  2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
  3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the participants to participate in the Competition.
  4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
  5. Should a participant not be available on the contact details provided during the timeframe stipulated above or rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived, and the Prize will be forfeited. Vodacom reserves the right to then award the Prize to the next randomly drawn participant.
  6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
  7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required documentation from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line.
  8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
  9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to any further use of his/her image and/or likeness or the image and likeness of their child being used and published by Vodacom in connection with the Competition (other than and in addition to what is contemplated in Part A, above) for a period of 12 (twelve) months after he/she has been announced as the winner. The winner may decline the use of his/her image and/or likeness by Vodacom.

Prize Delivery

  1. The following general conditions apply to the delivery of Prizes, unless otherwise indicated in Part A above.
  2. Vodacom and/or its Agent will determine the mode of Prize delivery at its discretion.
  3. If the method of Prize delivery is identified in Part A above, the clause applicable to that method of delivery as detailed more fully below will apply:
    • In the event of a Prize requiring physical delivery - delivery will take place via courier at dates, times and places agreed to between Openfield and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible, the Prize will be forfeited.
    • In the event of a Prize requiring physical collection – Vodacom or Openfield Marketing will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Vodacom nor Openfield shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s within 10 (ten) working/business days from the announcement and notification of the winners, failing which the Prize will be forfeited.
    • In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Vodacom or Openfield has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Neither Vodacom nor Openfield will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
    • In the event of data Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the Vodacom MSISDN (cell phone number) that the data must be transferred to.
    • In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification.
    • In the event of a Prize being an award on the VodaPay App, the winner must download the App and register on the App. Vodacom can only transfer money into the VodaPay wallet if the the winner has downloaded the App and registered on it. The cash Prize will be transferred into the winner’s VodaPay wallet within seven (7) working days after confirmation by the winner of their VodaPay details. Should the winner fail to meet the criteria for a period of ten (10) working days, the Prize will be forfeited.
  4. Should Vodacom or Openfield not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited.
  5. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, participants agree to such disclosure as is necessary to effect Prize fulfilment.
  6. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize (including for the reasons mentioned above), the Prize will be awarded to the next selected entrant.
  7. All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate.

Prizes are not transferable and right of admission is reserved

  1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
  2. No Prize can be redeemed for cash and may not be sold.
  3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.
  4. Where a Prize is for a Vodacom event(s) and / or experience(s):
    • it is restricted to the winner(s) of the Prize only - no additional guests will be allowed to enter or have access to the event(s) and / or experience(s), unless specifically stated otherwise;
    • Right of Admission to the event(s) and experience(s) is reserved by Vodacom;
    • Vodacom reserves the right to have a winner (and their partner and / or guest) removed from an event at any time should the behaviour or language of such winner or guest, at the discretion of Vodacom, be considered to constitute harassment or be inappropriate, including behaviour or language that is discriminatory or hateful on grounds such as race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth; and
    • Vodacom reserves the right to remove any winners (and their partner and / or guest) from an event at any time should their behaviour be considered to be dangerous to themselves or any other person or contravening any applicable health and safety requirements.

Undertakings, limitation of liability and indemnification

  1. Event(s) and/or experience(s), to which Competition Prize relates, may be hosted by third parties (for example, at sport stadia, theatres, convention or other centres owned by other entities) and all winner(s) will comply by the rules and regulations applicable to events held at such premises upon entry of such premises, and as may be stipulated by the owners of such premises.
  2. Entry to any events, experiences, and venues in respect of which Vodacom may give away prizes as part of competitions on its platforms, are bound and regulated by specific event or venue-related rules and regulations, which may be determined by event or venue owners or relevant governing bodies. By participating in this competition, Competition Participants:
    • acknowledge and agree that they are bound by such event, experience, or venue rules upon entry to such premises, event or experience;
    • undertake to adhere to and comply with any and all reasonable event, experience, or venue rules and/or regulations; and
    • indemnify Vodacom, its agents, or employees from any liability associated with Competition participants/winners failure to adhere to such rules and regulations and any damages that occur as a result.
  3. Vodacom and/or any other person or party associated with the Competition, their associated companies, partners, agents, contractors and sponsors and any of its personnel involved in the Competition, or a related event or experience shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition, from claiming the Prize, or attending an event or experience forming part of the Prize.
  4. Vodacom is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
  5. Vodacom cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize. Should the Prize be linked to a specific fixture, match, event or experience, and should that specific fixture, match, event, or experience be cancelled, interrupted, postponed, or otherwise affected by events or factors outside of Vodacom’s control or at Vodacom’s discretion, Vodacom cannot be held liable for the fulfilment of the Prize or be required to provide an equivalent or replacement Prize.
  6. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.

Personal information

  1. User data collected via the Competition will not be used for any other purpose than for the execution of the Competition.
  2. User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy.

Permission to receive marketing information from Vodacom

  1. By entering this Competition, you give Vodacom permission to send you marketing or promotional information about their products, services and other Competition.
  2. The entrant(s) will be given the option to opt out of receiving this information via the platform from which they receive the information.

General

  1. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.
  2. Vodacom may be bound by specific event-related rules and regulations that are determined by relevant governing bodies. These rules will be communicated to the competition participant and with which the competition participant agrees to comply.
  3. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  4. The judges’ decision on any aspect of the Competition, including the allocation of the Prizes, will be final and binding and no correspondence will be entered into.
  5. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final, and binding, and no correspondence will be entered into.
  6. Vodacom may refuse to award a Prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
  7. Vodacom is entitled in its entire discretion to reject any participant for any reason and will not be obliged to notify participants that they are rejected.
  8. Vodacom and/or any other person or party associated with the Competition, their associated companies, agents, contractors and sponsors and any of its personnel involved in the Competition shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition or from claiming the Prize.
  9. Vodacom is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.

If Vodacom is required by law to alter or cancel any aspect of the Competition or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Competition being offered, with immediate effect and without notice. In such event, all entrants waive any rights they may have against Vodacom and its associated companies, agents, contractors and/or sponsors.
  13. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

Upfront Payment Terms and Conditions

Upfront Payment Terms and Conditions

Upfront Payments (UFP) provides qualifying customers with the opportunity to obtain a cellphone contract and handset that they ordinarily would not qualify for. This is made possible by the customer making a UFP in store which payment is placed in a holding account linked to the customers Vodacom account for the duration of the contract term. The UFP reduces the monthly amount owed, making subscription repayments more affordable.

  1. The Upfront Payment (UFP) offer is only available to qualifying customers, based on Vodacom's standard credit vetting process.

  2. The upfront payment calculation is based on the customer's credit profile and the price plan selected.

  3. In order for an UFP deal to be processed, a debit or credit card payment must be successfully completed in store. No cash payments are permitted.

  4. The UFP amount will be split over the contract period into a monthly amount which will be deducted from the monthly subscription amount payable. This will reflect as such on the monthly Vodacom invoice.

  5. In the event that the customer wishes to cancel their contract before the term date, the remaining UFP balance will be subtracted from the cancellation fee payable at the time of the request. If any amount is owed to the customer thereafter, it will be refunded as per the current refund process.

  6. The UFP balance cannot be refunded and will be applied as outlined in point 5 above in the case of a contract cancellation. 

  7. All other existing premature cancellation rules will still apply.

  8. The UFP balance in the holding account will not accrue any interest over the contract period.

  9. Customers can contact a Vodacom store or call customer care on 082135 for additional information or queries.

  10. Vodacom reserves the right to amend or expand on these terms and conditions and where such amendment is material, Vodacom shall provide reasonable prior written notice of such change before it takes effect.
